If there ever were “the good old days” when it was an easy business to sell, finance and service automobiles, those days are well in the rear-view mirror. Delegates heading home from the largest-ever Western Canadian Dealer Summit, which kicked off at Banff Springs Hotel in Alberta, would have left scratching their heads at the pace of change and the fact that it’s coming from all directions.

CRA Issues New Guidance on Manufacturers Rebates
|
On November 21st, Canada Revenue Agency (CRA) issued guidance on the calculation of the Luxury Tax when considering third-party rebates such as those provided by manufacturers to consumers to encourage them to purchase vehicles.
This CRA guidance was issued without prior consultation with CADA or the vehicle manufacturers and comes completely out of the blue to industry and tax experts. The CRA web posting provides no technical insight and is unclear as to how the luxury tax is calculated going forward and perhaps retroactively. CADA shared the CRA information with manufacturers associations last week and we are working with them to clarify this latest approach. CADA is also working with MNP automotive tax experts on this issue.

Canada’s Modern Slavery Act Update
|
|
|
DEALERS MAY NO LONGER NEED TO REPORT
|
Last year Canada introduced new legislation aimed at fighting forced labour and child labour around the world in global supply chains. The Fighting Against Forced Labour and Child Labour in Supply Chains Act, formerly Bill S-211, and referred to as Canada’s Modern Slavery Act came into force on January 1, 2024 and dealers who were required to file a report had until May 31, 2024 to do so or risk facing penalties including fines per offense of up to $250,000, reputational damage and liability for officers and directors.
Based on feedback the government received from CADA and other national associations, Public Safety Canada issued updated guidance regarding reporting under this legislation for next year. One of the more significant changes is that they now state: “Entities solely involved in distributing and selling are not expected to report under the Act. Public Safety Canada will not seek enforcement action in those instances.” This is good news for many dealers who previously had to spend significant time determining if they had reporting obligations under the legislation as it gives greater comfort that businesses that were reporting solely because they engaged in sales or distribution activities won't be subject to enforcement action if they do not report. We note that there may be dealers that still need to report because they are importing goods. The changes to the Guidance do impact the scope of the term importing as well, so that it applies to the true importer of goods (not just limited to the importer of record as it previously was).

Canada to invest $18.6M in organizations to install L2-L3 EV chargers

As part of its effort to boost electrification in Canada, the federal government has announced that it will invest $18.6 million in multiple organizations to install more than
1,600 Level 2 and Level 3 electric vehicle chargers in Toronto, Ontario, and across the country.
The news came from Julie Dabrusin, MP for Toronto–Danforth and Parliamentary Secretary to Jonathan Wilkinson, Minister of Energy and Natural Resources. “To support Canadians driving EVs, where they live, work, travel and play, the Government of Canada is helping to build reliable and available charging options.”
Funding was provided through Natural Resources Canada’s Zero Emission Vehicle Infrastructure Program, with NRCan investments having already helped deploy over 41,000 EV.
